| 摘 要： | 文章指出研究立法听证范围的必要性在于限制听证的消极影响、保障立法机关一定的自主权利以及考虑现实的承受能力.确定立法听证的范围要遵循利益均衡原则和成本不大于效益原则.我国现阶段立法听证的范围可以采用原则性规定、列举性规定和排除性规定相结合的方式.

| Abstract: | A?study?of?the?scope?of?legislative?hearing?aims?at?restraining?its?negative?influence,?ensuring?some?autonomous?rights?of?the?legislative?body?and?taking?into?account?the?actual?acceptability.?The?scope?of?legislative?hearing?should?be?set?on?the?basis?of?balanced?interests?and?on?less?cost?but?more?profits.?At?present,?the?scope?of?legislative?hearing?can?be?set?by?combining?stipulation?of?principle,?stipulation?of?exemplification?and?stipulation?of?exclusion. |
