论环境权及其与生存权和发展权的关系

环境权是人的一项应有权利 ,当前 ,环境权开始得到越来越多的人们的认同 ,国际社会以及一些国家开始用立法和法律解释的方式对环境权加以确认 ,这是环境权从应有权利向法定权利的转化。环境权要成为一项实有权利 ,还是前路漫漫。环境权与生存权和发展权有着密切的联系 ,但是 ,它们之间又有着许多不同之处。所以 ,既不应把环境权与生存权对立起来 ,也不能把它们看做是同一项权利

On the Environmental Right in Relation to the Right to Survive and the Right to Develop

People are generally entitled to the right of the environment, and nowadays this has gained wider recognition. It has been justified in many countries and by international organizations through legislation and legal interpretation. This marks a change of the environmental right from a given right to a legal right. Nevertheless, we still have a long way to go to make it a firmly established substantial right. The author maintains that while the right of environment and the rights to survive and to develop are closely related, they are actually different in many aspects. We can neither separate them nor simply consider them as one right.
