关于我国现行法定婚龄的法律思考

我国现行法定婚龄是25年前以当时的经济发展水平和人口增长速度等社会因素为主要依据确定的,因而现在越来越与我国各族人民的身心发育规律、历史传统习俗、个人权利保障和民主法治建设以及国际发展趋势不相适应。为此,提出了在我国未来的《民法典》中修改现行《婚姻法》第6条、降低法定婚龄、增加除外条款、设立特许制度、删除晚婚晚育规定的解决方案。

Contemplation on the operating law of statutory marriageable age in our state

Our country's present statutory marriageable age is determined 25 years ago,mainly on the basis of the social factor of economic developing level and population increasing rate of that given time;therefore,it is getting more and more out of keeping with the law of mental and physical growth of people of all nationalities,the historical traditional custom,individual rights maintenance,democratic legal system building and international developing trend.For this purpose,thid article proposed a salvation plan including amending the 6th clause of the present Marriage law in future's Civil code of our country,lowing the legal marriageable age,adding exceptive clause,setting up concessionary institution,and deleting the regulations of late marriage and late childbirth.
