| 摘 要： | 由于中国现阶段法制不健全、信用机制和市场机制不完善,政府按照行政区划对污染物进行管理和控制,排污权交易制度到目前为止没有在中国形成一项正式的法律制度或政策。因此,在学习国外先进经验的基础上探讨排污权交易的原则、主体、对象、方式、监督和法律责任,对建立中国的排污权交易制度具有重要的理论意义和现实意义。

| Abstract: | Because of the unsound legal system,incomplete market-mechanism and credit mechanism,and because the Chinese government controls and manages the contamination according to regionalism,the pollution-removing trading system has not formed a legal policy or system so far in China.So after studying the advanced experience of foreign countries,it's very important to discuss the principle,body,object,mode,supervision and legal duty of pollution-removing trading system. |
