| 摘 要： | 规范性法律文件是智力活动的成果,具有独创性,属于作品范畴,所以援引时使用书名号是不容置疑的。然而,我国现行规范性法律文件在提及其他法律文件时,却存在着很多不规范、不统一现象。通过对大量立法例的实证分析,归纳了立法实践中存在的该用不用、用亦乱用、扩张使用书名号等诸多问题。

| Abstract: | Normative legal documents,as original works,are the products of intellectual activities;as a result,it is undoubtedly to use book title mark when they are quoted.However,the use of book title mark in China's existing normative legal documents is not standard and consistent when some other ones are mentioned.Based upon many legislative cases,this article is aimed at analyzing and summarizing the various issues of misusing book title mark in the legislative practice. |
