| 摘 要： | 胎儿虽然不是自然人，只是母体的一部分，但是胎儿有其自身的利益。现实生活中侵害胎儿利益的行为屡见不鲜。为了维护其及其出生长大为人后的利益，法律应当对胎儿利益予以保护。这种保护应包括来自民事和刑事的保护。

| Abstract: | Although fetus,as a part of matrix,is not a natural man,it has his own interests.Actions injuring fetus's interests in the reality are not rare.In order to maintain interests of fetus and its growing up,the law should protect fetus's interests.This kind of protection should include civil and criminal protection. |
