| 摘 要： | 《中华人民共和国担保法》将保证期间与诉讼时效相混淆.虽然最高人民法院关于适用《中华人民共和国担保法》若干问题的解释,将保证期间当作除斥期间,但又缺乏民法基本理论支撑,使保证期间在司法实践中的适用极为不便.本文依据民法的基本理论,基于担保法及其司法解释的视角,对保证期间的法律性质及其司法适用问题作了初步探讨.
