| 摘 要： | 船长公证职能是船长的五大职能之一。在详细阐述船长公证职能概念的基础上，结合船长公证职能的功能和中国《海商法》《公证法》的相关规定，分析船长公证职能法律制度的现状，并指出由于中国《海商法》没有规定真正意义上的船长公证职能，因此应当在立法中赋予船长适当范围的公证职能并加以监督。

| Abstract: | The captain's function of notarization is one of the five functions of the captain.On the basis of describing the concept of captain's function of notarization and existing CMC and Notarization Law,the paper analyzed the status quo of this institution,and drew the conclusion: because there is no real sense of the captain notary functions in CMC of China,the Legislative Council should give to the captain appropriate range of functions and supervise it. |
