转变经济发展方式的经济法对策思考

发展应以物质增量为基础，我国在现阶段发展中出现的不平衡、不协调、不可持续的问题也就是在物质增量利益的配置上出了问题。转变经济发展方式来应对这些问题，意味着我们需要完善经济法以重新调整物质利益关系。经济法是反映劳动力个人所有制要求，确认、设定和保护劳动力自益权的一个现代法律部门。完善经济法，就需要将劳动力个人所有制以及保护劳动力权写入宪法，并将经济法与社会法、奖励法有机地结合起来，以更好地调整资本逐利、劳动取酬和管理增收三方主体之间的物质增量利益关系。这样，才能从保护劳动力自益权、保障发展公平的意义上，科学地开发我国丰富的劳动力资源，从而顺利完成经济发展方式的转变提供强有力的法制保障。
