我国刑事案例指导制度实施现状及其对策——基于实证的分析

为遏制＂同案不同判＂现象,最高人民法院建立了案例指导制度,并发布了一些指导性案例。经实证调研发现,刑事案例指导制度的实施情况不容乐观,其功能也未能充分发挥,其中包括法官工作繁忙无暇学习指导性案例、类似案件的判断标准缺失以及刑事指导性案例的效力模糊等原因。为此,应建立指导性案例数据库、加强法官培训、探索建立类似案件的判断标准、明确并赋予指导性案例以强制性约束力等。

The Implementation of Criminal Guiding Cases and Its Solutions---Based on Empi rical Analysis

To eliminate the“identical cases having different verdicts” ,the Supreme Court established the Case Guidance System and released a number of guiding cases .The empirical research found that the im-plementation of the Criminal Case Guidance System was not optimistic ,and it did not work well .The reasons includes that judges are too busy to learning guiding cases ,lacking standards to judge the similar cases ,and the effectiveness of criminal guidance cases is vague .Therefore ,establishing guiding cases database ,training judges ,exploring the criteria for judging similar cases and enduing criminal guiding cases clearly mandatory binding are necessary .
