| 摘 要： | 主权财富基金因为其特殊的国家背景而备受注目。依据2004年通过的《联合国国家及其财产管辖豁免公约》，不同组织架构下的主权财富基金可能在国家豁免问题上的待遇各不相同。因此，管辖豁免的问题也应该成为中国新成立的国家财富基金考虑其组织架构的因素之一。

| Abstract: | SWFs has been paid remarkable attention due to its sovereign background.In Accordance with UN Convention on Jurisdictional Immunity of States and Their Property,SWFs under different organization structures may be treated differently in the area of state immunity.Therefore,State immunity problem shall be among the consideration for the organization of China's new SWFs. |
