行政权检察监督的定位与方式

从研究我国的政体出发,揭示了我国人民代表大会制度下"分权制约﹢专门法律监督"的国家权力结构,体现与西方三权分立的根本区别。从我国宪政定位分析,检察权以监督公权力为轴心,体现其本质属性是法律监督,这与大陆法系检察权的司法性、英美检察权的行政性存在明显差异。提出了符合中国的宪政实际的检察权定位,以及对行政权检察监督的具体方式构想。

Orientation and Method of Inspection and Supervision of Administrative Power:A Perspective of Constitutional Administration
