| 摘 要： | 搞要]本文通过对一则真实案例及相关案例进行法律的规则分析与经济分析的比较,得出在一般民事合同的履行中,因第三人的不法侵害甚或犯罪行为,导致合同一方当事人的生命、财产损失的,不应向合同对方当事人主张民事损害赔偿,进而说明法律的公正、效率的价值取向常常是统一的。

| Abstract: | Through the regulation analysis and economic analysis of a true case and relevant cases, this article draws the following conclusion: In the implementation of the civil contract, one party should not advocate civil compensation to the other side party when the third party made the malfeasance even criminal offence that caused life or property loss to the first one. Then it further expounds that the value orientation of the justice and efficiency is often unified. |
