| 摘 要： | 从务实的角度看,特别权力关系因回应了现实法制的需要,具有一定的生存空间,但随着民主法治的发展,它必然会向一般权力关系演进,并最终将被抛弃。在中国,实现特别权力关系向一般权力关系的演进,需要选择法治化路径:权利保护注重优位化,权力配置实现规制化,自由裁量体现合理化,自治行为彰显程序化,司法审查趋向渐进化。

| Abstract: | From a pragmatic point of view,special authority relationship power relationship responds to the needs of the legal system,so it has a certain space of survival.But with the development of democracy and rule of law,the trend of the evolution to general authority relationship cannot be ignored.Special authority relationship will eventually be discarded.In China,the evolution needs to choose the path on rule of law. |
