| 摘 要： | 正当业务行为形式上符合犯罪构成的特征，其正当性的根据在于它是一种具有机能作用的社会相当行为，且保护和促进的法益要大于所侵害的法益。正当业务行为具有人权、正义和自由的价值，我国刑法有必要予以法规化。

| Abstract: | The proper professional act formally conforms to the characteristics of the constitution of a crime. Its grounds of legitimacy lie in a kind of socially accepted behavior with functional roles, and the legal interests which is protected and promoted, are greater than the damaged ones. With value of human rights, value of justice and value of freedom, the proper professional action in the criminal law must be legalized. |
