| 摘 要： | 依法执政是一个综合性概念,它包含民主与法治、权利与义务等丰富的制度意蕴,融汇法律至上、权力制衡、权利保护 等诸多价值目标,涵盖执政党内部活动和外部活动的全部政党生活,贯穿执政党执政行为甚至自我管理的全过程。一般而论, 依法执政的核心内容是执政权的依法确立、依法行使和依法制约。具体而言,可以从依法执政的主客体、内容、目标价值、依据及 其与依法治国的关系等几个方面加以理解。依法执政要解决的首要问题是政权的合法性问题。其核心价值在于对公民权利和 自由的保障,对国家权力的有效制约,以及促进执政权威的确立。

| Abstract: | Reign according to law is a comprehensive notion including democracy , law, rights , obligation and others. In general , the core content of reign according to law is the lawful establishment of reign , exercising power and check. The first problem to solve is the validity of the regime. Its key value lies in the protection of civil rights and freedom , efficient checking of the national power as well as promoting the authoritative establishment of exercising power. |
