| 摘 要： | 信息不对称广泛地存在于市场交易中并损害市场的功能,而代理制度在拓展主体的法律行为空间、提高资源配置的效率、降低市场交易费用等方面表现出巨大的经济绩教。本文欲从信息不对称的角度来论述代理制度产生之必然及代理制度适应信息暴增、知识分裂而产生的相应的发展。并对代理制度立法提出自己的见解。

| Abstract: | Information asymmetry exists in market trade widely and damages the function of market. And agent system works greatly on developing scope of subject legal act, improving the efficiency of resource disposition, reducing the cost of trade expenses. From the aspect of information asymmetry, this article tries to discourse upon the certainty of the producing of agent system and its own change, which responds to the rapid increasing of information and specializing of subject. And some advice will be put forward on legislation of agent system. |
