| 摘 要： | 保险法上投保人的如实告知义务是一项先合同义务;告知义务人应当包括投保人和被保险人;告知义务人应当在保险合同订立时履行告知义务;保险合同复效时,投保人一方不必再履行告知义务;告知的方式应当为询问回答主义,履行有限的告知义务;投保人一方违反如实告知义务的后果包括保险人解除合同和提高保费,法律对于保险人的解除权的除斥期间应当作出明确的规定。
