| 摘 要： | 法经济学是法学和经济学交叉的产物,特色就是用经济学的理论和方法研究法律问题。国外现代法经济学的发展历程经历了法经济学的起源和萌芽时期、初创时期、成长时期以及稳步发展并走向深化的过程。法经济学研究在中国方兴未艾。从根本上讲,法经济学理论是一个动态的、开放的创造性过程。作为新兴的理论学科,法经济学还有待于进一步发展和完善,使其理论更加普遍化。

| Abstract: | Law and economics is an inter-discipline with the peculiar feature of applying theories of economics to the issues of law.Study of modern law and economics abroad has experienced stages of sprouting,starting-up,growing,developing and deepening.Scholars in China are also putting more and more emphasis on it now.Basically speaking,theory of law and economics is a dynamic,open and creative process.As a newly established discipline,it needs to be developed and perfected further so that it could be commonly applied in more fields. |
