| 摘 要： | 以罗马法的地役权制度为基础,梳理法国民法中的地役权制度并与之对比,归纳了法国民法的地役权制度在立法模式、主体、客体、权利义务方面对罗马法既有继受,又有丰富与发展,彰显出合理性、前瞻性与人权精神,在立法方面值得成为各国进行法律继承、移植活动的榜样。

| Abstract: | This article takes the Rome law＇s easement system as the research basis,combining the French Civil Law＇s easement system and making a contrast.Then the article sums up that the French civil law not only follows Rome law＇s easement system in the legislative mode,subject,object,rights and obligations,but also has enrichment and development,manifesting the rationality,prospective and human spirit.It＇s worth becoming an example in the aspect of legislation to national legal succession,transplantation activities. |
