| 摘 要： | 对于工程建设活动所适用的法律规范体系的研究,可以在经济法、民法、行政法等多个部门法的视角下进行。提出了我国工程建设法的调整对象应当主要包括工程建设主体管理关系、工程建设市场监管关系、工程建设宏观调控关系、工程建设涉外管理关系等内容;工程建设法律规范体系结构应当归纳为工程建设主体法律制度、工程建设市场监管法律制度、工程建设宏观调控法律制度和工程建设涉外管理法律制度。分析了工程建设法即工程建设法律规范体系与工程建设法学之间的关系。

| Abstract: | This article puts forward that the research of construction law can be carried forward under the perspective of economic law,civil law and administrative law.Then the article elaborates that the regulating method of construction law shall include the administrating relationship of construction subject,supervising relationship of construction market,macro-control relationship of engineering construction and construction relationship of foreign management.Besides,the article illustrates that the structure of construction law should be concluded as the subject of engineering construction,the supervising law of construction market,the marco-control law of construction and the foreign management of construction.Lastly,the article analyzes the relationship of construction norms and construction law. |
