中央与地方立法权力关系的变迁

中央与地方立法权力关系是国家法律体系建构中无法回避的理论和实践问题之一。从我国中央地方立法权力关系的演变看,尽管不同历史时期地方权力大小各异,但相对于中央立法权,地方立法权是逐步扩大的;在中央立法权缩减的同时,地方立法权总体上呈扩张趋势,究其原因在于我们对国家结构形式与分权关系认识的加强、治理方式的民主化和差异性国情下的市场经济。面对纷繁复杂的中央与地方立法关系,我们应在法制统一的原则下,适当扩大地方立法权;实现立法权的均衡下放;力求权力配置上法制化和科学化,运用立法监督制度规范中央地方立法权力关系。

The Changing of Legislative Power Between the State and Local Government

How to seperate the legislative power between the state and local government is an essential issue when we construct China's legal system.In the development of legislative power,local legislative power has been expanding,in spite of its constant changes in different periods.Because we concern the structure of state and the decentralization of power,the democratization to the state administration and market economy in different national condition.Facing complicated legislative relations between the state and local government,we should appropriately expand the legislative power of the local government,realize the transference of legislative power to the lower in checks and balances,strive for the institutionalization and scientization in authority allocation,and standardize the relations of legislative power between the state and local government through legislative supervision in the principle of uniform legal system.
