法律视野中的湿地和湿地自然保护区

湿地是与森林、海洋并称的地球三大生态系统之一。我国湿地资源丰富,但目前湿地面临着面积锐减和功能退化的威胁。法律视野中的湿地和湿地自然保护区存在着立法进程不快、执法管理不力、公众参与不够的问题。由此提出的对策建议是:积极稳妥地推进《湿地法》的立法、出台专门的《湿地自然区保护条例》、按“一区一办法”的思路制定地方法规、加大现行法律法规执法的力度、不断扩大公众的参与。

A Legal Research on Wetland and Wetland Nature Reserve

The wetland together with forest and oceans called the great ecosystem in the whole world.The resource of wetland is abundant in China. But wetland faces the thread that the area decreased and fractions deteriorated at present.Research on wetland and wetland nature reserve in the law visual,presented the problem that the progress of legislation was slow,enforcement's administration was not dint,the public participation was lack.This paper advanced suggestions and countermeasures as follow: we may actively and steadily force the legislation of wetland law;we may make the implemental regulations of wetland nature reserve.We may set down the place laws according by "one area by one way",we may enforce the law in effect,we may extend the public participation continuously.
