| 摘 要： | 目前我国行政立法的法律不太完备 ,其中有关行政立法的程序方面的法律条文的制订尤其欠缺 ,发挥行政立法的程序价值显得非常迫切 ,如通过参与性价值可以提高行政立法的民主性和科学性 ;通过选择性价值体现权利和义务的平衡 ,限制行政机关恣意 ;通过制约性价值达到对行政机关的最终监督。实现行政立法的程序价值的途径在于 ,积极地实现参与性价值 ,灵活地实现选择性价值和强制地实现制约性价值。

| Abstract: | At present, laws of administrative legislation are not fairly complete, and laws and regulations about procedure of administrative law are especially deficient. Therefore, it is obviously an urgent requirement to realize the value of procedure in administrative legislation. Such realization may be achieved in several ways. The value of participation may increase the democratic and scientific level in the administrative legislation, the value of option may embody the balance of right and obligation restricting the unscrupulous behavior in the government, and the value of conditioning may ultimately realize the supervision on administrative organizations. The approach to the realization of the procedure value in administrative legislation is to realize the value of positive participation, to realize the value of option flexibly and to realize the value of conditioning compulsorily. |
