试论婚姻的本质

众多婚姻理论的歧义性表明,各种婚姻论说中一旦引入婚姻的功能性要素来界说婚姻的本质时,也就进一步遮蔽了婚姻的本质。婚姻本质的界说,应该首先剥离各种次生的功能性关联,最后唯有性以及性关系或性行为是婚姻的中心事实,是婚姻的核心指向。婚姻的本质就在于,它是对人类性行为的制度性规范。
