| 摘 要： | 为补救初级规则,哈特的法律规则理论引入作为次级规则的承认规则和裁判规则。两大规则的核心基础均为官员,尤其是法官接受的内在观点,这决定了两大规则间必然存在密切联系。在法律空缺与不确定条件下,承认规则对裁判规则的内在鉴别,裁判规则对承认规则的不确定性规制。
