统筹城乡环境治理的地方立法研究

统筹城乡环境治理是我国城乡一体化的重要组成部分,只有合理规划城乡布局,统筹治理城乡环境治理立法,改变城乡二元结构,才能实现城乡全面、协调、可持续发展.我国地方环境治理存在部门保护主义和地方保护主义突出、立法能力不足、立法程序与宪法监督缺失等问题.因此,在统筹城乡环境治理立法过程中,必须协调行业利益与地方利益的关系,厘清中央与地方立法的权限,构建统筹城乡环境立法的利益协调机制以及相应的地方立法宪法监督制度.

Local Legislation on Coordinating Urban and Rural Environmental Governance

Coordinating urban and rural environmental governance is an important part of the integration of urban and rural areas in China. Only through reasonably planning urban and rural layout, making laws to coordinate urban and rural environmental governance and changing the urban-rural dual structure can the all-round, coordinated and sustainable development of urban and rural areas be achieved. There exist many problems in local environmental governance, such as serious departmental and regional protectionism, poor legislation capability, lack of supervision over legislative procedure and lack of constitutional supervision. Therefore, in the process of the legislation on coordinating urban and rural environmental governance, it is necessary to coordinate the interests between different trades and regions, clarify central and local legislative jurisdictions, and build an interest coordination mechanism to coordinate urban and rural environmental governance and relevant constitutional supervision mechanism over local legislation.
