| 摘 要： | 关于作品标题的法律保护问题,目前我国法律规定很不明确。作品标题具有自身的法律特性,对作品标题,国外目前存在不同的几种保护方式。结合我国具体的立法渊源,我国对作品标题的法律保护应该综合采取版权法保护、反不正当竞争法保护、商标法保护等方式以及商品化权保护方式。

| Abstract: | The domestic legal rules are very unclear on legal protection to the title of a literary work. The tide of a work has its own special characters in law. There are several protections of the title of a work in other counties. Combined with the special source in domestic law, we should protect the tide of a work as follows: protection based on copyright law; protection based on anti-unfair competition act; protection based on merchandisingright act introduced recendy. |
