论行政法治中的诚信价值

行政法治是一国行政法实施和实现的基本理性判断,而行政法治中的价值选择是促成行政法治的前提条件。诚信价值作为若干价值中的一个其对行政法治所能起到的作用是其他价值无法取代的,它具有促成行政法治权威、行政法治自证、行政公信力和行政法治正当期待的意义。目前行政法治中诚信价值可由行政基本秩序由法律设定、行政法规范保持稳定、行政设定义务具有可实现性、行政执法行为保持同等对待、行政承诺行为必须兑现等范畴构成。要确立行政法治中的诚信价值,制定行政诚信法、减少行政权法外运作频度、行政权的行使归属于行政系统等是必须选择的路径。
