| 摘 要： | 鸦片战争后一系列不平等外交和约的签定,一方面紧紧束缚中国人民的手脚,使近代中国法制的发展打上了殖民化的印记;另一方面西方法文化也随之传入中国,刺激了近代中国传统法制的现代化转型。列强通过外交和约对晚清经济自主法权、政治自主法权、外交自主法权的侵夺,在客观上对法制现代化的启蒙有一定的促进作用。

| Abstract: | After Opium War ( 1840 ) in which Britain defeated China ,the two sides signed a series of unequal treaties. On one hand , Britain controlled Chinese Legal system through the treaties. On the other hand ,the treaties promoted modern transformation of traditional legal systems of China, including economic law, politics law, and diplomatic law. |
