| 摘 要： | 物权法草案就留置权的适用范围采扩张性的法律制度设计,此与我国传统民事立法关于留置权的特点及效力定位不相符合。“留置的权利”之概念的提出及其与留置权、抗辩权间相协调的制度安排,或许是保持我国传统留置权适用范围限缩性的一剂良方。

| Abstract: | According to the Draft of Real Right Law, the applicability of lien has be expanded to other fields. This runs counter to the features and validity of lien in traditional civil legislation in China. The solution to this problem is to limit the application of traditional lien system by the formation of the con-cept of "right to lien" and the coordination of the right to lien, the right to keep lien, and the right to counterplea. |
