原告住所地与网络侵权案件的法院管辖

计算机网络的发达给人们提供了更多的资讯和更加快捷的联系方式,但与此同时,越来越多的网上侵权案件也给我们传统的司法制度提出了一系列新的问题,其中网络侵权案件的民事诉讼管辖便是突出问题之一。依照我国现行法律规定,因侵权行为(包括一般侵权案件和网络侵权案件)提起的诉讼,只能由侵权行为地法院或者被告住所地法院管辖,但网络侵权纠纷具有不同于一般侵权纠纷的特殊性:遭受网络侵权的原告往往难以确定实施网上侵权行为被告的住所地以及侵权行为地点,原告处于起诉困难的窘境。本文认为,应当从计算机网络的特点出发,对传统管辖理论和网络管辖新理论、网络案件侵权行为地以及外国相关的理论进行梳理,尤其是应借鉴美国的长臂管辖权理论。原告住所地人民法院应当成为网络侵权案件的管辖权法院之一,这可以给原告更大程度的法院管辖选择权,从而在司法实践中有效地解决网络侵权案件原告起诉难问题。
