| 摘 要： | 在金融危机背景下，如何进行海外投资监管以更好地控制和规避风险，成为当前立法的一项重要工作。分析我国海外投资监管立法及其实践的现状，研究现有的立法资源，结合实践中具有典型性的案例，指出其中存在的立法体系不合理、内容繁杂滞后、立法位阶低、执行不力、事后监管缺位等问题。根据我国具体情况，借鉴国际经验，在立法与实践的相关方面提出完善我国海外投资监管实践的建议。
