| 摘 要： | 行政权的膨胀造成行政侵权案件的增多,行政侵权给相对人带来物质损害和精神损害。而我国至今尚未有行政侵权的精神损害赔偿制度,这有违建立法治社会的目标。本文从理论和现实层面对建立行政侵权的精神损害赔偿制度作出分析。

| Abstract: | With the expansion of the administrative power, more and more administrative infringement of right cases appearing, which bring about material and moral damage to the people, corporate person and social group. However, there is no moral damage compensation system in our country, which is not in keeping with our aim of building our country ruled by the law. The present article , from both theory and practice, make a deep analysis as to how to set up the moral damage compensation system to deal with administrative infringement of right. |
