累犯制度实务难题的理论诠释

一般累犯与毒品再犯竞合情形下的适用规则、缓刑期满后故意犯罪能否构成累犯、累犯前罪的刑罚执行完毕是否包括附加刑等,都是司法实务中的疑难问题。随着刑法修正案(八)对累犯制度的修正与完善,又产生了特殊累犯范围和不满十八周岁的人犯罪除外认定等新的争论。累犯制度整体观、量刑情节之间同质基础上的互补性、一般规则对特殊规则的制约性、累犯从重处罚根据的复合性等,是有效解决司法实务难题的重要理论依据。

Theoretical Interpretation on the Practice Problems in Recidivist System

There are some puzzling questions in the judical practices,such as the rules in competition situations for the common recidivist and recidivist of drug related crimes;after probation,if the criminals execute the intentional crime,he can constitute a recidivist? The completion of the execution of recidivist sin before,whether the punishment including accessory punishment? As the amendment and the pomotion of the eighth amendment of the Criminal Law,there are new argument arising,for example: the scope of the special recidivist;exclusion rule for the under the age of 18 to commit a crime.In this article the author proposes the new opinions,such as the concept of viewing the recidivist system s a whole;complementarity on the basis of homogeneous on the measurement of penalty;conditionality for the general rule to the special rules;compositonality reasons on the heavier punishment recidivist.All aboved opinons are very important theory basis to solve the problem in the judicial practice effectively.
