| 摘 要： | 文章结合我国刑法第140条及最高司法机关相关解释规定,探讨了生产、销售假冒伪劣产品罪的销售金额、货值金额与定罪量刑标准之间的联系;分析了生产、销售金额计算中的一些问题;并剖析了现有立法中的若干缺陷。

| Abstract: | Based on Article 140 of the "criminal law" and its authoritative interpretation, the author discusses the correlation between the sales and value of commodities in the crime of "producing and marketing fake commodities and the criterion applied in imposing a penalty for the crime. The paper also! features an analysis of the problems in calculating the sales and value of commodities in the crime of" producing and marketing fake commodities" and some of the shortcomings of the current legislature. |
