| 摘 要： | 不真正连带债务是大陆法系国家普遍认可的一种多数人债务。这种债务与连带债务不同,两者不能混淆。鉴于不真正连带债务具有许多独立的价值,且适合当前司法实践需要,我国应当建立该制度,在民法典中对之做出明确规定。

| Abstract: | As a kind of obligation of several parties acknowledged by continental law system,untypical joint and several obligation,is different from joint and several obligation.Therefore,they cannot be confused with each other.The system of untypical joint and several obligation has many independent values and adapts to current judicial practice,so the system ought to be founded in our country and stipulated definitely in civil law code. |
