| 摘 要： | 目前 ,有关正当防卫的著述颇多 ,但正当防卫中侵害行为范围这一关乎正当防卫是否成立的问题却被忽视。本文就正当防卫中不法侵害的内涵、一般防卫和特别防卫侵害行为的不同范围以及特别防卫侵害行为的判断主体和时机问题进行探讨。

| Abstract: | Although there are lots of books on due defense at present,we have neglected the problem whether it is tenable of the scope of infringement act on due defense or not. The purpose of the author is that we should not only analyze on the problems such as intension of infringement act of breaking law on due defense, different scopes of ordinarily and particularly due defensive act, but body and opportunity of judgment on particularly defensive act. |
