| 摘 要： | 现有研究较少关注科技发展与环境刑法适用之间的关系。探讨“科技发展与环境刑法适用”源于对“科技与犯罪”的关注。一个系统的分析显示,环境刑法不能独立于当代科技发展水平独立适用,具体表现在三个方面：一是罪与非罪的判断,包括环境犯罪罪名的创设;二是影响此罪与彼罪的认定,个案的裁判理由应具有科学上的依据;三是影响环境刑罚,包括环境刑罚刑种的配置以个案中刑事责任大少的具体裁量。

| Abstract: | Nowadays, few people pay attention to the relationship between the technological development and environment criminal law application. Our discussion on this topic resulted from the concern about Technology and Crime： A system analysis shows environment criminal law cannot be applied independently because the level of technological development will limit the application of the law. Technological development will affect the application of environmental criminal law from the following three aspects： 1 ） It will affect the judgment on whether it is a crime or not, including new offense creation ; 2） It will affect the affirmation of this crime or the other, including science-based judicial trial grounds announced ; 3 ） It will affect penalty configuration and penalty sentencing. |
