域外电子数据证据可采性的新发展及启示

电子数据证据可采性是电子数据证据认定中最为棘手,也是目前我国司法实践中颇具争议的一个问题。新修民事诉讼法中正式确立电子数据证据为一种法定证据形式,但遗憾的是只确认了电子数据的证据效力,未对电子数据的可采性及其相关问题作出明确规定。在借鉴有关国家成功经验的基础上,结合我国实践需求及发展程度,应制定包含最佳证据规则、鉴真规则与传闻证据规则的电子数据证据可采性规则。

New development and enlightenment of admissibility of electronic data evidence in foreign countries

The admissibility of electronic data evidence is the most complex and one of the controversial issues in legal practice in China. The electronic data evidence is formally confirmed as one of the legal forms of evidence in the newly revised Civil Procedure Law, but it is a pity that the evidential effect of electronic data is confirmed, while the admissibility and related issues of electronic data are not clearly regulated. Based on referencing the successful experiences of other countries, and combined with the practical demand and degree of development, the rules of admissibility should be constituted of best evidence, authentic identification and hearsay evidence.
