| 摘 要： | 在法制现代化进程中,民间法与国家法的矛盾较为突出,法制现代化西方化范式在中国法治化进程中出现很多矛盾,不利于法治秩序的建构与法律权威的树立.反思中国法制现代化建设中国家法与民间法的作用十分必要.文章从国家法与民间法的关系入手,对两者作用进行辨析,并提出整合办法.

| Abstract: | In legal modernization there are some obvious contradictions between the popular law and the state law. Many contradictions have arisen in the westernized paradigm of the legal modernization in the process of legalization in China. This situation works against constructing the legal order and legal authority. It is therefore imperative that we reflect on the functions of the state law and the popular law in the construction of legal modernization in China. This article has analyzed the functions of the state law and the popular law regarding their relationships, and put forward ways to integrate the two laws. |
