南海古代国家与争议岛屿史地考证的若干法律问题

中国人发现南海和南沙群岛是个历史的过程。古代的中国人移民形成了不少的南海古国,南海古国中也有的发展成为比较强大的国家,其中个别国家与东盟国家还存在继承关系。本文着重就南海古代国家与南海争议岛屿密切相关的若干历史和法律问题进行讨论,主要提出一些需要进一步论证的问题,希望能够为南海争议岛屿主权归属史地考证工作提供参考和借鉴。

Some Legal Problems Concerning Ancient Countries in the Nanhai and Histo- geographical Textual Researches of the Controversial Shoal -islands

China’s discovery of Nanhai and Nansha Archipilago is a historical process.Ancient Chinese immigrants has formed a lot of ancient countries in Nanhai.Of them some have developed into countries comparatively strong,a few of them even have relation of inheritance with ASEAN Countries.This paper emphatically discuss some historical and legal problems closely-related with ancient countries in Nanhai and controversial Shoal-islands in Nanhai.This author is mainly intended for proposing some problems called for further expounding and demonstrating,hoping to provide good and bad lessons for the histo-geographical textual researches,of the sovereignty of the Nanhai controversial Shoal-islands.
