南沙岛礁领土争议法律方法不适用性之实证研究

解决南海存在的南沙岛礁领土归属争议,利用和平方法是必须遵循的原则。本文分析了利用和平方法(政治方法和法律方法)处理南沙岛礁领土争议问题的基础和障碍,阐述了国际司法机构的管辖权制度,特别指出了遵守"搁置争议、共同开发"原则的重要性和实施过程中存在的困难,得出南沙岛礁领土争议问题无法利用法律方法解决的结论。最后,本文提出完善我国海洋问题政策与法制等方面的具体对策建议。

Empirical Researches on Non-application of Legal Means to Territorial Disputes over Nansha Islands and Reefs

The principle of settlement by peaceful means shall be adhered to. This paper mainly attempts to explore the basis and obstacles of settling territorial disputes over Nansha Islands and Reefs by peaceful means (political and legal means), to expound the jurisdiction system of international judicial organization, specially to point out the importance and some difficulties while setting aside disputes and conducting joint development, and to conclude finally that territorial disputes over Nansha Islands and Reefs can not be solved by legal means. At last, it puts forwards specific solutions and suggestions on improving China’s policy of marine issues and related legal system and proposes corresponding counter measures.
