论安乐死的合法性及其法律规制

安乐死可以分成很多种类,每一种类在学理和伦理上的可责难性是不同的。在实践中,最为常见的是绝症病人因无法忍受痛苦而主动要求对自己实施的安乐死,即主动安乐死和自愿安乐死。界定含义后的安乐死,体现了尊重人性、维护生命尊严的人道主义关怀,在维护病人利益的同时,也得到了社会大众的认可,因而不具社会危害性。最后,安乐死的实体立法可通过在刑法中增加新的正当行为条款来实现,程序法规制方面,可以通过单独立法的形式规范其申请、审查、批准、执行、备案等适用程序。

On the Legality and Legislation of Euthanasia

Euthanasia can be divided into several types which are quite controversial in legal and moral field.In the judicial practice,the most common case is that terminally ill patient who could not bear the tortures of pain and ask to be euthanized,which is initiative and willing euthanasia.After defining the meaning,euthanasia does not do harm to the society for it reflects the humanitarian which means to respect for humanity and protect life dignity;maintains patients’ right while getting public recognition.At last,we can realize the substantive legislative of euthanasia by adding new articles of legal act in criminal law,and the legislative process by special legislation to regulate its procedure for application,review,approval,implementation and filing.
