“三包”有效期的适用问题研究

“三包”是我国消费者保护体系中的一项重要制度，但在实践中常常有销售者混淆“三包”有效期和《产品质量法》诉讼时效的概念，推卸责任。实际上“三包”有效期和《产品质量法》的诉讼时效并无冲突，只是前者适用于产品质量违约责任，后者适用于产品质量侵权责任。通过对两种责任的比较研究以及“三包”有效期的合理性分析，阐述如何合理运用“三包”有效期以及《产品质量法》诉讼时效对消费者权益进行双重保护。

Appropriateness of Expiration Date of the "Three Guarantees of Repair, Replacement and Refund of Substandard Products"

The ＂three guarantees of repair, replacement and refund of substandard products＂ is an important institution in the system of customers＇ rights and interests protection. In order to avoid certain liabilities, some sales agencies mislead the concepts of expiration date and limitations of legal proceedings prescribed in Product Quality Law. Actually these two time limitations are not inconsistent because each limitation is suitable to only one liability. This paper aims at the theoretical analysis of rationality of expiration dates and comes up with the importance of applying expiration dates to protect customers＇ rights and interests.
