新时期制定我国《石油天然气法》之思考

《石油天然气法》是石油天然气行业的基本运营规则,新时期制定我国《石油天然气法》具有重要意义。制定《石油天然气法》应遵循科学发展原则、体制创新原则、普遍性和特殊性结合原则、法制统一原则。基于我国石油天然气行业混合经营的现状以及历来的立法传统,为了追求内在法律精神的统一,促进石油天然气行业的协调发展,我国《石油天然气法》应采取全行业统一立法模式。从法的表现形式而言,我国《石油天然气法》应借鉴国外的有益经验,其法律条款力求详尽而具有可操作性。从调整的重点内容而言,我国《石油天然气法》应对行业发展战略、监管体制、从业主体资格、企业社会责任、海外投资开发、储备机制、法律责任等加以详细界定。

Consideration on Enacting China's Oil and Natural Gas Law in the New Era

An oil and natural gas law is the fundamental operation rule of the industry of oil and natural gas,and enacting the oil and natural gas law of China is of great significance in the new era.To enact the such a law,the principles of scientific development,system innovation,combination of universality and particularity and legal system unity should be followed.Considering china's present situation of unified operation in the industry of oil and natural gas and constant tradition of legislation,for the sake of achieving the unity of inner law spirit,promoting coordinated development in the industry of oil and natural gas,the oil and natural gas law of China should adopt a unified legislative mode for the whole industry.In view of manifestation,the Law should draw useful experiences from foreign countries,its provisions should be detailed and operable.While in view of adjustment of key contents,industry development strategy,supervision system,qualification of business identity,social responsibilities of enterprises,overseas investment and development,reserve system and legal responsibilities should be clearly defined in the Law.
