| 摘 要： | 企业法律形态改革的目标模式不应确定为以独资企业、合伙企业和公司企业为主导的模式,而是应既包括所有制形态的企业形式,也包括资本形态的企业形式;两类企业法律形态应并存,而不应该有所偏废甚或取消前者而以后者取代前者。国有企业、集体企业是重要的企业法律形态,其地位、作用不应被贬抑。

| Abstract: | The state-owned enterprise and collective enterprise are very important legal formations. The solely-invested enterprise, partnership and corporation should not be the leading legal formations. The legal formations of enterprises in China should include the legal formations of both ownership enterprise and capital enterprise. |
