| 摘 要： | 依法理,投稿人向出版者提供的抄袭剽窃之作一旦骗得发表,除对著作权人的知识产权构成侵犯外,同时对出版者也是合同欺诈行为。对此类根本违约行为,出版人有权追究抄袭剽窃者合同违约的法律责任。

| Abstract: | According to law, if a person submits a plagiarized article to publisher and once the article is published , he infringes the copyrighter's intellectual property and also causes contract swindle to the publisher. To this action of breaking contract, the publisher has the right to investigate the plagiarist's legal responsibility. |
