| 摘 要： | 传统理论认为抵押权以保全债权为要务,即强调抵押权附随于债权。但随着社会经济的发展,抵押权的附随理论正受到挑战,一些国家的立法出现了抵押权的独立化与证券化的发展趋势,因为它能够在投资融资等方面发挥积极的作用,从而满足了社会资金需求。当前对我国来说,亦有抵押权证券化的现实需求。

| Abstract: | In traditional theory,mortgage aims at guaranteeing credit,i.e.mortgage is subordinate to credit.With the development of social economy,the theory of mortgage is challenged,and there is one trend of independence and securitisation of mortgage in legislation of some countries,because it can play an active role in investment and financing and provide funds for our society.Our country is in need of securitisation of mortgage. |
