社区矫正立法新进展及完善

社区矫正是刑罚执行制度改革的一项尝试。从先行试点到正式立法已经走过了七年有余。立法是对改革成果的肯定。刑法修正案（八）将社区矫正制度正式纳入，具有重要的现实意义。可是，过于原则的立法仍然存在社区矫正适用范围狭窄、执行主体不明确、立法衔接不协调等问题。对此，应当进一步加以完善，以便使社区矫正制度的实施更加顺利。

New Progress and Perfection in Communication Correction Legislation

As a part of the reform in penalty implementation sys- tem, communication correction has been adopted for more than 7 years, from pilot programs to official legislation. Communication correction leg- islation is a relection of the reform achievements. That Amendment VIII to Criminal Law officially stipulates communication correction system is of great practical significance. However such problems still exist as nar- row application, undefined implementation subject, the discoordination of legislation, etc. Therefore, further perfection of community correction system is required to enable its better implementation.
